Capucine Lanta de Bérard practises exclusively in criminal law, particularly in the areas of corporate, business and public life criminal law. She advises and defends both individuals and companies facing issues in these areas (misuse of company assets, fraud, money laundering, breach of trust, tax evasion, deception, bankruptcy, forgery and use of forged documents, unlawful taking of interest, corruption, favouritism, obstruction of justice, psychological or sexual harassment, sexual assault and psychosocial risks).
Capucine also assists companies and their directors in detecting and preventing acts of corruption or related offences, and is involved in internal investigations, covering both integrity issues and psychosocial risks.
Capucine Lanta de Bérard also acts in all areas relating to unintentional offences, from workplace accidents to mass accidents (particularly aviation or industrial accidents). She worked alongside Daniel Soulez Larivière on the AZF case, notably on the issue of the impartiality of the trial panel, which led to the quashing of the appeal judgment in 2015.
Finally, Capucine continues to practise in her core area of expertise, public health criminal law – she was notably involved in the so-called ‘PIP implants’ case – as well as in environmental criminal law, areas in which complex, cross-cutting issues of compensation arise, particularly involving serial damage and often involving a large number of claimants.
Among the most recent cases she has handled, Capucine secured the acquittal of her client in the Wendel case (tax fraud), the acquittal of her client, a hearing aid manufacturer prosecuted for deception (public health – fraud and falsification), following a very lengthy investigation lasting over 13 years at the Marseille Public Health Division, and a dismissal of the case in the Dropped case (air crash – manslaughter).
