Our firm is particularly committed to the issue of personal data protection, which stems directly from the right to privacy.
We are constantly developing effective solutions to secure the deletion of our clients’ personal information contained in public or private, national or international records (INTERPOL Red Notices, criminal records, FNAEG, TAJ, etc.).
We also take action to enforce the “right to be forgotten” online, particularly when issues related to image and reputation are at stake (defamation, unlawful advertising, etc.).
Finally, we support and advise companies on the management of their employees’ personal and/or protected data—both in the implementation of data collection tools and in the subsequent processing of the data—to enable them to adapt to the strengthening of the legal framework in this area.
Examples:
- Secured the removal of the entry for Bulletin No. 2 from the criminal record following a conviction in a drug trafficking case before the Paris Court of Appeals
- Secured the removal of the entry for Bulletin No. 1 regarding a prior conviction pursuant to the provisions on judicial rehabilitation.
- Successfully obtaining the removal of data from the TAJ (Criminal History Processing) database held by the Investigating Chamber, following an objection by the public prosecutor’s office, in accordance with the principles reaffirmed by the European Court of Human Rights regarding the requirements of strict necessity and proportionality, and in consideration of the impact of retaining the data on the conduct of professional activities (risk of non-renewal of security clearance).
- Secured the deletion of personal data from the FNAEG (National Automated DNA Database) for a client convicted of acts of intentional violence.
- Assisted several individuals who were victims of defamatory and/or abusive comments on the internet. Conducted pre-litigation negotiations, requested the removal of content from search engines, and pursued legal action where necessary.
- Advising an online publishing platform. Reviewing the privacy policy and providing assistance in its dealings with third parties on matters related to personal data protection.
- Advising on the implementation of a system for collecting ethical alerts regarding personal data protection.
